Is homebrew allowed or does it count as emulation?

What would you be using homebrew for? Note that the rules state:

NTR video capture is NOT acceptable

he also posted the same in donkey kong wii lol idk a lot about homebrew but there he says that he doesnt have the phisical copy of the game so prob the same

it would basically just be a digital copy so as long as you're not using it to record i think it would be fine
