Even if you are on Emulator, I don't know how you would get sub 40. Unless more songs could be timewarped (skipping choruses, attack phases, etc.) or songs can be skipped, that doesn't seem likely to happen.

PS2 Any% End Timing Rule Changed
Rule has changed to account for opening the disc tray when END appears for each song.
"Time starts on selecting Level 1.
Time ends on the thunder strike after beating Zowie OR when U-1's pose appears on screen after opening the disc tray.
Opening the disc tray to skip songs is allowed."
