If the game capture disappears at any point, the submission is invalid, unfortunately. If it remains on the screen it shouldn't be an issue unless an important part of the game screen is blocked.

Unfortunately, you cannot, unless you had a PC account to sync save files with, or some method of modifying the Switch's memory via a PC (not really feasible, but technically possible).
