you can use Fabric, the mod loader you just can't use the Fabric API mod

Yes, Fabric Loader is perfectly legal (and needed for the mods to work), but Fabric API is a separate mod (.jar file) that you have to insert, and that is illegal. Every legal mod works without Fabric API.
