in the speedrun rules it reads Assist Mode is not allowed. would this count towards the controller aim assist mode in settings?

The controller aim assist mode may not be included I suppose, since it doesnt offer any buff like extra damage or any shield. Just make sure the egg on the setup page is not hatched.
